Insurance claim “Mischief” for super yacht owner – The time value of money is highlighted by this case!

One to watch. The owner of Australia’s largest superyacht, the 54m Baglietto-designed Mischief I, is suing a group of Lloyd’s insurers for £4m over an unpaid claim. Legal documents in the case allege the insurers refused to cover the cost of storm damage the vessel suffered during a voyage between Papua New Guinea and Brisbane in 2023.

While we await the defence docs to see the grounds of refusal, the time this case has taken to get to court is already worth registering. The damage took place in November 2023. The claim was notified within days. It then took nine months for coverage to be declined and another 10 months for the matter to make its way to court. So nearly two years after the event took place, the claimant is only just starting the process of getting the dispute resolved.
